Membership and Use of Service

  1. Call Com Inc. membership is open to all individuals providing they are 18 years old and above.
  2. As a member or user of Call Com Inc. you are responsible to all the activities, or transactions undertaken on your account including all the information or content you enter on this website.
  3. You agree that you will be held liable against any claims, chargeback, penalties, fines or fees incurred by Call Com Inc., a Member, or a third party due to your breach of this agreement, and/or use of the services on this site.
  4. You also understand that Call Com Inc. reserves the right to suspend or terminate your account if these Terms and Conditions are breached.
  5. You may use Call Com Inc. Services only for lawful purposes. You agree that you may not use Call Com Inc Services for the following reasons:

    2. in any way that is unlawful or fraudulent or has any unlawful or fraudulent effect;
    3. to send any unsolicited or unauthorized advertising or promotional material or any form of SPAM;
    4. to register or join and use the Call Com Inc. service on behalf of another party without the party’s explicit consent;

Payments and Refunds

  1. You understand that all sale or subscription transactions are final. Products and services you avail on this site are subject to Call Com Inc.  pricing fees.
  2. Call Com Inc.  retains the right to modify or make any changes on the fees of the services without any prior notice. Please check our services page regularly for any modifications regarding service fees.
  3. In case you requested for a refund, you understand and agree that the refundable amount may be subject to transaction fees or service charge.
  4. You also understand and agree that you as a member/user/licensee under no circumstances will be entitled to a refund for leads purchases. All purchases for leads service are final and not refundable.

Limitation of Liability and Disclaimer of Warranties

  1. CALL COM INC. WILL NOT BE HELD LIABLE TO ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES THAT RESULT FROM USE OR INABILITY TO USE CALL COM INC.
  2. THE SERVICE, CONTENT OR INFORMATION MADE AVAILABLE ON THIS SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” BASIS. YOU UNDERSTAND AND AGREE THAT CALL COM INC. EXPLICITLY DISCLAIMS ANY REPRESENTATIONS, OR WARRANTIES OF ANY KIND EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE TITLE OR NON-INFRINGEMENT.
  3. CALL COM INC. MAKE NO WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT YOUR ACCESS TO IT WILL BE UNINTERRUPTED, TIMELY, ERROR FREE, OR SECURE. 
  4. YOU ALSO UNDERSTAND THAT CALL COM INC. DOES NOT WARRANT THE ACCURACY OF THE CONTENT CONTAINED ON THE SERVICE. YOU CONSENT THAT YOUR PARTICIPATION OR USE OF CALL COM INC. SERVICE ARE SOLELY AT YOUR OWN RISK.

Indemnity

  1. You agree to indemnify, defend, and hold harmless Call Com Inc., and its Affiliates, Services Providers, Respective Officers, Directors and Employees, from any and all claims (including third party claims) or demands, damages, losses, costs and expenses (including legal costs) arising out of or consequential upon the use of the Service or relating to breach of your agreement contained in this terms and conditions.

Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws and proceedings of the Republic of the Philippines. Any dispute concerning these Terms and Conditions shall be subject to the exclusive of the Philippine court although Call Com Inc. reserves the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.
